معيقات التقاضي الإلكتروني في الجزائر

Abstract

شهد المجال القضائي تأثيرا مباشرا للتطور التكنولوجي والثورة الرقمية، حيث واكب هذه التحولات باعتماد الرقمنة والانخراط في مسارها من خلال تطبيق نظام التقاضي الإلكتروني، الذي يعد من أبرز آلياتها. ويفترض أن يسهم هذا النظام في تعزيز الضمانات القضائية من خلال تسريع معالجة القضايا والبت فيها، وتسهيل الولوج إلى العدالة، وتبسيط الإجراءات. وقد بادر المشرع الجزائري إلى إقرار مشروع رقمنة قطاع العدالة في هذا السياق. غير أن الواقع العملي كشف عن جملة من الصعوبات التي تعترض تجسيد هذا التحول، إذ لا يعني اعتماد الإدارة الإلكترونية أن التنفيذ سيتم بسلاسة، بل تواجهه عراقيل متعددة يمكن تصنيفها إلى إشكالات قانونية، وأخرى تتعلق بالعنصر البشري، بالإضافة إلى معوقات مادية. الكلمات المفتاحية: التقاضي الإلكتروني، رقمنة العدالة، العدالة الرقمية، التحديات الإلكترونية، معوقات التقاضي الإلكتروني. Abstract The judicial sector has been directly impacted by technological advancement and the digital revolution. It has kept pace with these developments by adopting digitization, most notably through the implementation of electronic litigation, which is considered one of its main mechanisms. This system is expected to enhance judicial safeguards by accelerating case processing and resolution, facilitating access to justice, and simplifying procedures. In this context, the Algerian legislator initiated a project to digitize the justice sector. However, practical reality has revealed a number of challenges hindering this transformation. The adoption of electronic administration does not necessarily imply smooth implementation, as several obstacles arise—these can be categorized into legal issues, human resource-related challenges, and material constraints.
