Abstract

اتجهت السياسات العقابية الحديثــــــــــــــــة إلى البحث عن بدائـــــــــــل العقوبة السالبـــــــــــة للحرية، خصوصا العقوبة السالبة للحرية قصيرة المدة، ويعتبر نظام الوضع تحت المراقبة الالكترونية من أحدث هذه البدائل، وأنجعها باعتبارها يقوم على قضاء المحكوم عليه، كل أو جزء من عقوبته خارج أسواء السجن، أو ما يعرف بالسجن المنزلي مع إخضاعه لعدد من الالتزامات ومراقبة تحركاته عن بعد في نطاق مكاني محدد ومدة زمنية معلومة، ويهدف هذا النظام إلى التقليص من سلبيات العقوبة السالبة للحرية التي أثبتت فشلها في إصلاح المحكوم عليهم، وأدت إلى تزايد عدد المحبوسين مما أدى إلى اكتظاظ في المؤسسات العقابية، الأمر الذي يقابله زيادة في حجم النفقات التي تتكبدها الدولة. الكلمات المفتاحية: الوضع تحت المراقبة الالكترونية، المراقبة عن بعد، الســــــــــوار الالكتروني، بدائل العقوبة السالبة للحرية، نظام تكييف العقوبة.

Abstract: Modern penal polices have shifted toward alternatives to custodial sentences, particularly short-term custodial sentences. Electronic monitoring is considered one of the most recent and effective of these alternatives, as it involves the convict serving all or part of his sentence outside walls, or what is known as home confinement, while subjecting him to number of obligations. And monitoring his movements remotely within a specific spatial scope and for a known period of time. This system aims to reduce the negatives of the negative of the penalty of deprivation of liberty, which has proven its failure to reform convicts, and has led to an increase in the number of prisoners, which has led to overcrowding in penal institution, which is met with an increase in the amount of expenses incurred by the state.
