Item الطرق البديلة لتسوية المنازعات التجارية - دراسة تحليلية على ضوء قانون ااجراءات المدنية و الادارية(مكتبة كلية الحقوق و العلوم السياسية جامعة محمد البشير الابراهيمي برج بوعريريج, 2025-05-05) بن جدو حنان; بن زيوش آيةلقد تبنى المشرع الجزائري من خلال قانون الإجراءات المدنية والإدارية، طرقا بديلة لحل النزاعات التجارية، وهي الوساطة والصلح والتحكيم، حيث نظمها المشرع تنظيما موضوعيا وإجرائيا مبينا إجراءات كل منهم وطرق اللجوء إليهم فاللجوء إلى هذه الطرق البديلة يعتبر طريقا وديا لتسوية النزاع، ويرتكز على رغبة وموافقة الأطراف المتنازعة للوصول إلى حل ودي للنزاع وتجنب اللجوء إلى القضاء وما تحمله طياتها من تعقيد في الإجراءات وتضييع الوقت. الكلمات المفتاحية: وسائل بديلة، الوساطة، الصلح، التحكيم، الحل الودي. Résumé The Algerian legislator, through the Civil and Administrative Procedures Code, has adopted alternative methods for resolving commercial disputes, namely mediation, conciliation and arbitration. The legislator organized them objectively and procedurally, indicating the procedures for each of them and the ways to resort to them. Resorting to these alternative methods is considered an amicable way to settle the dispute, and is based on the desire and agreement of the conflicting parties to reach an amicable solution to the dispute and avoid resorting to the judiciary and the complexity of the procedures and waste of time that it entails. key words: Alternative means, mediation, conciliation, arbitration, amicable solution. .Item الوساطة و الصلح في النزاعات التجارية في التشريع الجزائري(مكتبة كلية الحقوق و العلوم السياسية جامعة محمد البشير الابراهيمي برج بوعريريج, 2025-02-05) عثامنة عبير; يسعد أميرةسعيا من المشرع الجزائري لمواكبة تطورات المجال التجاري والحفاظ على خصوصيته قام بإصدار القانون رقم 22/13المعدل والمتمم للقانون رقم 08/09، واستحدث محاكم تجارية متخصصة تعمل بالموازاة مع الأقسام التجارية الموجودة وفرض على الخصوم اللجوء إلى اجرائي الصلح والوساطة كطرق للتسوية الودية للمنازعات المعروضة أمام القضاء التجاري، وهذا هو موضوع دراستنا لمعرفة الأحكام الجديدة المتعلقة بالإجراءين: فالصلح تنظره المحاكم التجارية المتخصصة أما اجراء الوساطة التي تنظره الأقسام التجارية بالمحاكم الابتدائية وفقا لما ورد في القانون السالف الذكر. الكلمات المفتاحية: النزاعات التجارية، الوساطة، القسم التجاري، الصلح، المحكمة التجارية المتخصصة. Abstract In order to keep pace with developments in the commercial field and preserve its privacy, the Algerian legislature issued Law No. 22/13, amending and complementing Law No. 08/09. This law introduced specialized commercial courts to operate alongside existing commercial divisions. It also mandated that litigants resort to conciliation and mediation procedures as friendly settlement methods for disputes brought before commercial courts. Our study focuses on the new provisions concerning these procedures: conciliation is handled by specialized commercial courts, while mediation procedures fall under the jurisdiction of commercial divisions in the courts of first instance, as stipulated in the aforementioned law.
