الإطار القانوني للإستثمار في الجزائر

Abstract

يتناول هذا البحث دراسة وتحليل الإطار القانوني للاستثمار في الجزائر، من خلال عرض المفاهيم الأساسية المرتبطة بالاستثمار، وتطور السياسة التشريعية، مرورا بالآليات القانونية والتنظيمية المعتمدة، لا سيما القانون 22-18. كما يسلّط الضوء على فعالية هذه المنظومة القانونية في جذب الاستثمار، ومدى توافقها مع المعايير الدولية، وأثر الإصلاحات الأخيرة، قبل التطرق إلى أبرز العراقيل القانونية والإدارية التي تعيق تحقيق بيئة استثمارية مثلى. وقد خلصت الدراسة إلى ضرورة مواصلة الإصلاحات لضمان استقرار التشريعات وتحسين مناخ الأعمال. الكلمات المفتاحية: الاستثمار، قانون 22-18،البيئة القانونية، الضمانات، البيروقراطية، المناخ الاستثماري. Abstract: This research analyzes the legal framework of investment in Algeria by presenting the fundamental concepts related to investment and the evolution of legislative policy, focusing particularly on the legal and regulatory mechanisms in place, especially Law No. 22-18. It also highlights the effectiveness of this legal system in attracting investment, its alignment with international standards, and the impact of recent reforms, before addressing the main legal and administrative obstacles hindering the creation of an optimal investment environment. The study concludes with the necessity of continuing reforms to ensure legal stability and improve the business climate.
