التعبير الإلكتروني عن الارادة في التعاقد التجاري

Abstract

إن دراستنا لموضوع التعبير الإلكتروني عن الإرادة في التعاقد التجاري، نتيجة للتطورات الحاصلة والتقدم الرقمي في مختلف المجالات وحداثة التكنولوجيا التي لعبت دورا بارزا في تطوير وسائل التعاقد الإلكتروني بين الافراد حيث حددت الدراسة طرق التعبير عن الإرادة الإلكترونية وما يعيقها من إشكالات تقيد صحتها، والتي اضفى عليها المشرع الجزائري، نفس احكام التعاقد العادي، فلا يختلف الأمر إلا فيما يتعلق بالوسيلة المستخدمة للتعبير عن الرغبة في إبرام العقد وفقا لتطابق الإيجاب والقبول. كما أصدر القانون 18-05 المتعلق بالتجارة الإلكترونية والذي بدوره برز من خلال المفاهيم القانونية الجديدة التي تتعلق بالتعبير عن الإرادة عبر الوسائل الإلكترونية بخصوص الواقع الاقتصادي والتجاري دون اللقاء المادي للمتعاقدين لإبرام هذه العقود. الكلمات المفتاحية: الإرادة،الإيجاب الإلكتروني، القبول الإلكتروني،آثار التعاقد الإلكتروني. Our study of the topic of electronic expression of will in commercial contracting stems from the developments and digital advancements across various fields, as well as the modern technologies that have played a significant role in enhancing electronic contracting methods between individuals. We examined the means of expressing électroniqueWill and the challenges ThatMay hinder its validity. The Algerian legislator has applied the same provisions of traditional contracting to electronic contracts, with the only difference being the medium used to express the intention to conclude the contract, based on the conformity of offer and acceptance. Additionally, Law No. 18-05 on electronic commerce was enacted, introducing new legal concepts related to the expression of will through electronic means, particularly in the economic and commercial spheres, without requiring the physical presence of the contracting parties to conclude these agreements.
