منازعات الترقيم العقاري في التشريع الجزائري

Abstract

إن ضرورة تطهير الوضعية العقارية للبلاد أدى بالمشرع الجزائري إلى إصدار العديد من التشريعات لتنظيم الملكية العقارية وتبنى في ذلك نظام الشهر العيني الّذي يعتمد على تسجيل الحقوق العينية على العقارات ويقوم نظام الشهر العيني على مجموعة من الإجراءات المركبة والمتتالية تبدأ بعملية مباشرة المسح العام للأراضي في إقليم بلدية ما، وبعد اتمامها يتم إيداع وثائق المسح العقاري لدى المحافظة العقارية المختصة إقليميا، ثم تليها عملية تأسيس السجل العقاري وإنشاء البطاقات العقارية للعقارات الممسوحة، ثم يتم ترقيم العقارات إما مؤقتا أو نهائيا، ويخضع الترقيم العقاري للطعن الإداري أمام المحافظ العقاري المختص إقليميا أو الطعن القضائي بنوعيه العادي والإداري. الكلمات المفتاحية: الملكية العقارية، المنازعات العقارية، منازعات الترقيم العقاري، وثائق المسح، المحافظة العقارية، الدفتر العقاري، إشكالات الترقيم.

Abstract The necessity of purifying the country's real estate situation led the Algerian legislator to issue many laws to regulate real estate ownership, In this regard the real estate registration system was adopted, which is based on registering real rights on real estate. The monthly eye system is based on a set of complex and successive procedures, It begins with the process of conducting a general survey of the lands in the territory of a municipality, This is followed by the process of establishing the real estate registry and creating real estate cards for the surveyed properties, The properties are then numbered either temporarily or permanently. Real estate numbering is subject to administrative appealbefore the regionallycompetent real estateregistrar or to judicialappeal of both the ordinary and administrative types.
