تمويل الترقية العقارية في التشريع الجزائري

Abstract

أصبح لنشاط الترقية العقارية أهمية استراتجية في السياسة العامة للدولة الرامية لتنمية قطاع السكن و التخفيف من الأزمة الحالية في مجال السكن ، و هذا نظرا لما شهده من إعادة تنظيم و ضبط من الناحية القانونية من خالل إصدار القانون رقم 11/04 و بعض المراسيم التنفيذية له ، الأمر الذي أعطى دفعا كبيرا لهذا النشاط كونه محركاأساسيا لقطاع السكن في البلادإذ فتح المجال للإستثمار في نشاط الترقية العقارية في العديد من المجاالت المرتبطة به سواء في رصد الأوعية العقارية أو في الإنجاز و إدارة المشاريع العقارية وكذا الاستثمار في تمويل هذه المشاريع العقارية المنجزة في إطار الترقية العقارية. وعليه فان هذه الدراسة جاءت لتركيز على جانب التمويل باعتباره حلقة أساسية في إتمامأي مشروع منجز في اطار الترقية العقارية لاسيما ذات الطابع السكني من خالل ابراز أهمية تمويل هذا النشاط و خصوصياته و اثار هذا الاستثمار على تنمية قطاع السكن بالجزائر. الكلمات المفتاحية : التمويل، الترقية العقارية، السكن، الجزائر.

Abstract : The real estate promotion activity has become a strategic importance in the general policy of the state aimed at developing the housing sector and alleviating the current crisis in the field of housing. This is due to the reorganization and control of the law through the issuance of Law No. 11/04 and some executive decrees, Which gave a great impetus to this activity as a key engine for the housing sector in the country as it opened the way to invest in the promotion of real estate in many areas related to him, both in the monitoring of real estate vessels or in the completion and management of real estate projects as well as financing these real estate projects completed in Ata Real estate promotion. Therefore, this study is focused on the financing aspect as a key link in the completion of any real estate project completed in the framework of the promotion of real estate, especially the residential character by highlighting the importance of investment in financing this activity and its specialties and the impact of this investment on the development of housing sector in Algeria.
