النظام القانوني للسجل التجاري الالكتروني

Abstract

سعى المشرع الجزائري إلى تهيئة بيئة قانونية وتنظيمية ملائمة لممارسة التجارة الإلكترونية، من خلال إصدار جملة من القوانين والمراسيم الرامية إلى عصرنة قطاع التجارة، لا سيما من خلال تطوير السجل التجاري نظرا لأهميته الإحصائية، الاقتصادية، والإشهارية،وقد تمحور اهتمامنا حول مدى تنظيم المشرع لقواعد السجل التجاري الإلكتروني، خاصة وأنه يمثل تشفيرة ضمن النظام المعلوماتي للمركز الوطني للسجل التجاري. ويعد صدور القانون رقم 18-05 المتعلق بالتجارة الإلكترونية محطة مفصلية ساهمت في تفعيل الأحكام التشريعية ذات الصلة بالسجل التجاري، من بينها القانون رقم 18-04 المحدد لشروط ممارسة الأنشطة التجارية، المعدّل والمتمم، والذي أعقبه صدور المرسوم التنفيذي رقم 18-112 المحدد لنموذج مستخرج السجل التجاري الإلكتروني، المعدل والمتمم، والذي أقرّ وجوب مطابقة سجلات التجار غير الحائزين على الرمز الإلكتروني، ما جعل من الالتزام بالسجل التجاري الإلكتروني ضرورة حتمية في البيئة التجارية المعاصرة. الكلمات المفتاحية: السجل التجاري الإلكتروني، التشفيرة، التجارة الإلكترونية. Abstract The Algerian legislator has sought to establish a legal and regulatory environment conducive to the practice of electronic commerce by enacting a series of laws and decrees aimed at modernizing the commercial sector, particularly through the development of the commercial register, given its statistical, economic, and publicity functions. This study focuses on the extent to which the legislatorhas regulated the rules governing the electronic commercial register, especially as it constitutes an encrypted element within the information system of the National Center of the Commercial Register. The enactment of Law No. 18-05 on electronic commerce marked a significant turning point in the implementation of legislative provisions related to the commercial register. This includes Law No. 18-04, which outlines the conditions for conducting commercial activities, as amended and supplemented, followed by Executive Decree No. 18-112, which defines the model of the electronically issued commercial register extract, also amended and supplemented. This decree mandates the compliance of all traders not possessing the electronic code with updated registry requirements, making adherence to the electronic commercial register a commercial necessity in the modern business environment.
