الآليات القانونية لحماية البنايات من خطر الإنهيار في القانون الجزائري

Abstract

يواجه قطاع البناء في الجزائر تحديات كبيرة في تطبيق الأطر القانونية و التنظيمية الكفيلة بضمان السلامة الإنشائية و حماية الأرواح و الممتلكات من خطر الإنهيار. و يعد الإلتزام بالآليات الوقائية كالرخص و الشهادات العمرانية ، إلى جانب المواصفات التقنية من الركائز الأساسية لضبط جودة البناء و الحد من أخطار الكوارث ، كما تتحمل الأطراف الفاعلة كالمالك و المقاول و المهندس ، مسؤوليات مدنية و جزائية عند الإخلال بالضوابط القانونية أو الفنية . و رغم التطورات التشريعية ، لا تزال الحاجة قائمة لتفعيل أكثر صرامة للمنظومة القانونية ، و تكثيف الرقابة ، و توعية المعنيين بأدوارهم ، لضمان بيئة عمرانية آمنة و مستدامة . الكلمات المفتاحية: الحماية،انهيار ،رخص التعمير ،المواصفات التقنية، مطابقة، التنمية المستدامة، المسؤولية.

Summary : The construction sector in Algeria faces significant challenges in implementing the legal and regulatory frameworks necessary to ensure structural safety and protect lives and property from the risk of collapse. Compliance with preventive measures, such as permits and urban planning certificates, along with technical specifications, is considered a fundamental pillar in controlling construction quality and minimizing disaster risks. Key stakeholders—such as the owner, contractor, and engineer—bear civil and criminal responsibility when legal or technical regulations are violated. Despite legislative developments, there remains a pressing need for stricter enforcement of the legal framework, increased oversight, and greater awareness among stakeholders about their roles, to ensure a safe and sustainable urban environment.
