الحماية الجنائية للمجالات المحمية في التشريع الجزائري

Abstract

لقد أعطى المشرع الجزائري المجالات المحمية أهمية كبيرة حين خصها بقانون خاص ينظمها ويقر حمايتها فبعد أن كانت مدمجة في القانون رقم 1-10-03 المتعلق بحماية البيئة في إطار التنمية المستدامة أصبحت تخضع لأحكام القانون 11 -02- المؤرخ في 17 فيفري 2011، وتهدف هذه الدراسة الى تسليط الضوء على هذا القانون الذي أعطى للمجالات المحمية حماية أكبر من خلال تعريفها وتحديد عناصرها وأصنافها ومراحل تصنيفها وطرق تسييرها وتبيان الأحكام الجزائية واجبة التطبيق على المعتدين على نظامها ومكوناتها من حيث النشاط المجرم والعقوبة المقررة له استجابة لما لها من دور رئيسي في حماية التنوع البيولوجي والأنظمة البيئية. الكلمات المفتاحية: المجالات المحمية التنمية المستدامة، الأحكام الجزائية، التنوع البيولوجي Abstract: The Algerian legislator gave the protected areas great importance when he singled them out by a special law that regulates them and approves their protection. After they have been incorporated into law no.10-03 relating to the protection of the environment within the framework of sustainable development, they become subject to the provisions of law no.02-11 of February 17m2011,this paper aims to shed light on this law that gave protected areas greater protection by defining them and determining their components, classes, methods of operation, and penal provisions applicable to those who violate its systems and components in terms of criminal activity and penalty prescribed for it their to its essential role in protecting biological diversity and environment systems Keywords: protected areas, sustainable development criminal provisions, biological diversity.
