Abstract

تولي التشريعات الجزائرية أهمية كبيرة لإجراءات البحث والتحري في الجرائم الإلكترونية، نظرًا لتعقيداتها وطبيعتها التقنية. ينص قانون الإجراءات الجزائية المعدل بموجب القانون رقم 06-22 على تمكين الضبطية القضائية من استعمال وسائل تقنية متطورة للكشف عن مرتكبي هذا النوع من الجرائم. تشمل هذه الإجراءات المراقبة الإلكترونية، واعتراض المراسلات عبر الوسائط الرقمية، والتفتيش الإلكتروني للأجهزة والأنظمة المعلوماتية. كما أتاح المشرع إمكانية الاستعانة بخبراء تقنيين لتحليل الأدلة الرقمية. يتم تنفيذ هذه الإجراءات تحت إشراف النيابة العامة أو قاضي التحقيق ضمانًا لاحترام الحقوق والحريات. وتسهم هذه التدابير في تعزيز فعالية مكافحة الجريمة الإلكترونية وضمان العدالة. الكلمات المفتاحية: الجريمة الإلكترونية، اعتراض المراسلات، التفتيش الإلكتروني، الضبطية القضائية، التعاون الدولي. Abstract : Algerian legislation attaches great importance to investigation and research procedures in cybercrimes, given their complexity and technical nature. The Code of Criminal Procedure, amended by Law No. 06-22, empowers judicial police to use advanced technical means to detect perpetrators of this type of crime. These procedures include electronic surveillance, interception of correspondence via digital media, and electronic inspection of information devices and systems. The legislature also allows for the use of technical experts to analyze digital evidence. These procedures are carried out under the supervision of the Public Prosecutor or the investigating judge to ensure respect for rights and freedoms. These measures contribute to enhancing the effectiveness of combating cybercrime and ensuring justice.
