إجراءات الهدم بين الرخصة وَالقرار في التشريع الجزائري

Abstract

ملخص: تدعيمًا للجهود المبذولة من طرف المشرع الجزائري قصد مكافحة المخالفات الناجمة عن الأنشطة العمرانية، وتفعيلًا للرقابة الإدارية المفروضة على الأشغال المرتبطة بها، عَمَدَ إلى تطبيق رقابة متزامنة مع الأشغال منذ البدء فيها إلى غاية إنهائها، وذلك من أجل ضبط التوسع العمراني غير القانوني كيفما كان نوعه؛ وتتمثل هذه الرقابة أولاً في نظام الترخيص المتمثل في رخصة الهدم التي تمنح بطلب من المعني بتقديمه الملف قانوني كامل، وثانيًا في قرار الهدم عندما يتم التعدي على ملكية عقارية أو البناء المخالف لقواعد العمران. الكلمات المفتاحية: التهيئة وَالتعمير-رخصة الهدم- قرار الهدم- الضبط العمراني وَالبيئي. Abstract: In support of the efforts made by the Algerian legislator to combat violations resulting from urban activities, and to activate the administrative control imposed on related works, the Algerian legislator has implemented a simultaneous control of the works from the beginning until their completion, in order to control illegal urban expansion of any kind; this control is represented first in the licensing system, represented by the demolition permit, which is granted at the request of the concerned party by submitting a complete legal file, and second in the demolition decision when real estate property is infringed or construction in violation of urban rules is carried out. key words: Urban planning and development - Demolition permit - Demolition decision - Urban control and environment.
