آليات تطهير الملكية العقارية في التشريع الجزائري

Abstract

تعتبر الملكية العقارية الطريق القانوني والوحيد لتحقق الأمن والاستقرار وكذا الحد من الفوضى والمنازعات التي تحصل في هذا المجال الأمر الذي دفع بالمشرع الجزائري إلى خلق هذه الاليات اهمها شهادة الحيازة والتحقيق العقاريفي الاراضي غير الممسوحة ومسح الاراضي كآلية في الاراضي الممسوحة الذين اعتبرهما المشرع الجزائري كآليات تمكن من تطهير الملكية العقارية.

Summary: Real estate ownership is considered the only legal means to achieve security and stability, as well as to reduce chaos and disputes in this field. This has prompted the Algerian legislator to establish certain mechanisms, the most important of which are the Certificate of Possession and property investigation in unsurveyed lands, and land surveying as a mechanism for surveyed lands. The Algerian legislator considered these mechanisms as tools that enable the purification of real estate ownership.
