النظام القانوني للآبار في التشريع الجزائري

Abstract

إن المشرع الجزائري قام بتنظيم استخراج المياه الجوفية عن طريق حفر الآبار التي تعتبر أهم وسيلة لاستخراجها من أجل تزويد المناطق التي تعاني من شح الأمطار و قلة المياه ، خاصة بالمناطق الصحراوية و صنفها حسب الاستعمال كآبار استعمال فلاحي وآبار استعمال صناعي و آبار استعمالتجاري ...إلخ ، فقام بسن قانون المياه رقم 05-12 و النصوص التنفيذية وتنظيمية مع إعطاء صلاحية للولاة بالتدخل و إصدار قرارات المتعلق بتنظيم استعمال هذه المياهو تسهيل الحصول عليها ، كما نجد أن المشرع الجزائري ، حسب هذا القانون وضع شروط قانونية و أخرى التقنية من أجل الحصول على رخصة أو امتياز لاستعمال الموارد المائية الجوفية و التي تعتبر من حق كل شخص طبيعي أو معنوي الحصول عليها كما بين الواجبات التي تقع على عاتق المستغلين و ألزمهم باحترامها. كما أن المشرع الجزائريأولى أهمية بالغة في تنظيم عملية إنشاء الآبار و كلف جهات مختصة لمنح تراخيص لاستعمال الموارد المائية الجوفية ، فعملية إنشاء الآبار لا تتم بطريقة عشوائية ، بل تمر بعدة مراحل محددة من تكوين ملف للحصول على الترخيص إلى دراسة هذا الملف و يهدف المشرع من ذلك إلى ترشيد استغلال الموارد المائية الجوفية و ضمان استدامتها . كما أن قواعد الحماية التي وضعها المشرع الجزائري تهدف إلى ضمان سلامة المورد المائي من حيث الكمية و النوعية خاصة في ظل التغيرات المناخية و زيادة حدة الجفاف مما أدى إلى ضغط كبير على المياه الجوفية ، لذا سن المشرع مجموعة من النصوص القانونية لحماية هذا المورد الهام و الحيوي من الاستنزاف و التلوث و منع الإضرار بالبيئة المائية ، و ذلك من خلال وضع مجموعة من الجهات الحكومية متخصصة التي أوكلت لها مهمة السهر على حماية هذه المياه و ذلك كل حسب اختصاصه و فرض عقوبات على كل من يخالف ما جاء في هذه النصوص القانونية .

The Algeria legislator has regulated the extraction of groundwater therough the drilling of wells which is considered the mostimportant method for accessing this resource in order to supply areas that suffer from low rainfall and water scarcity especially in desert regions the legislator categorized wells according to their use such as wells for agricultural purpses wells for industrial use and wells for commercial use among others accordingly law N 05-12 on water was enacted aloug with its implementing and regulatory texts and to facilitate accessto it we find that the algerian legislator according to this law the algislator established legal and technical conditions for obtaining a license or concession to use groundwater resources which are considered a right that any natural or legal person may the law also outlined the obligations of users andrequired them to comply with these responsibilties The Algerian legislator also attached great importance to regulating the process of well construction and entrusted specialized outhorities with the task of granting permits for the use of groundwater resources the process of constructing wells is carried out in a rondom or unregulated manner rather it goes through several defined stages starting with the preparation of a file to obtain the permit followed by the review and assessment of this file the legislator aims through this process to rationalize the use of groundwater resources and ensure their sustainability the protective regulations established by the algerian aim to ensure the safety of water resources in terms of both quantity and quality especially in light of climate change and and the increasing severity of droughts which haveled to significant pressure on groundwater therfore the legislator enacted a set of legal provisions to protect this vital and essential resource from depletion and pollution and to prevent harmto the aquatic environment this was achieved by establishing a group of specialized governmental bodies each entrusted with the responsibility of ensuring the protection of these the responsibility of ensuring the protection of these water resources within the scope of its jurisdiction along with the imposition of penalties ou anyone who violates the provisions of these legal texts
