النظام القانوني للعقار السياحي في التشريع الجزائري

Abstract

باعتبار أن السياحة في الوقت الحاضر بعيدة عن المستوى المطلوب مقارنة بالمؤهلات السياحية فإن الجزائر على غرار كل العالم تحاول جاهدة الاستفادة من النمو العالمي للعقار السياحي، من خلال العمل على إبراز المقومات والمؤهلات السياحية التي تتميز بها، مما يجعلها قطبا سياحيا وبالتالي التنويع في الناتج الوطني الذي يعتمد فقط على مداخيل المحروقات في الوقت الذي يمكن للسياحة ان تكون بديلا حقيقيا له. وانطلاقا من كل هذا أصبح العقار السياحي بجميع مكوناته مفتاحا لتطور الجزائر، وهنا يقع عبء التعريف به وتحديد أليات استغلاله على المشرع الجزائري، خاصة وأن المجتمع مازال غير متفتح على قيمة العقار السياحي الذي يشكل ثروة وطنية مهمة. الكلمات المفتاحية: العقار السياحي، السياحة، المؤهلات السياحية، المقومات السياحية، النشاط السياحي.

Abstract : Given That tourism currently falls far short of the desired level compared to its tourism potential, Algeria, like the rest of the world, is striving to benefit from the global growth in tourism real estate by highlighting its distinct tourism assets and potential. This will position It as a tourism hub and thus diversify the national product, which relies solely on hydrocarbon revenues, at a time when tourism can be a real alternative. Based on all of this, tourism real estate, with all its components, has become key to Algeria's development. The burden of defining it and defining its exploitation mechanisms falls on the Algerian legislator, especially since society is still not open to the value of tourism real estate, which constitutes a significant national resource.
