النزاعات الناشئة عن الصفقات وطرق تسويتها

Abstract

يعالج موضوعنا منازعات الصفقات العمومية في ظل المرسوم الرئاسي 15 / 247 المتضمن تنظيم الصفقات العمومية والمرفق العام . وقد تم في هذه الدراسة تحديد الإطار المفاهيمي للمنازعات وتصنيفها باعتماد على معيارين العضوي والمادي مما يساعد على فهم تنوع هذه المنازعات وانعكاساتها القانونية والعملية . كما تناولت المذكرة الإطار القانوني المنظم للصفقات العمومية في التشريع الجزائري . وقد خصصنا فصلا كاملا لدراسة طرق التسوية المعتمدة سواء الودية ( الوساطة ، التحكيم ، التفاوض ) أو التسوية القضائية . الكلمات المفتاحية:منازعة الصفقات، التسوية الودية، التسوية القضائية، الإخلال بلتزمات العقد. Abstract Our study addresses public procurement disputes under Presidential Decree 15/247 regulating public procurement and public services. This study defines the conceptual framework for disputes and classifies them based on two criteria: organic and material. This helps understand the diversity of these disputes and their legal and practical implications. The memorandum also addresses the legal framework regulating public procurement in Algerian law. We devote an entire chapter to examining the established settlement methods, whether amicable (mediation, arbitration, negotiation) or judicial settlement.
