اتفاقية بازل لحماية البيئة من النفايات الخطيرة

Abstract

إتفاقية بازل للتحكم في النفايات الخطيرة والتخلص منها عبر الحدود .هي اتفاقية أبرمت سنة 1989 ودخلت حيز النفاذ في 1992 تتناول بشكل أساسي حماية البيئة من أضرار النفايات الخطرة عن طريق وضع التزامات دولية تتمثل في منع تصدير النفايات الخطرة فلكل دولة الحق السيادي في حظر استيراد النفايات الخطرة وتفرض اتفاقية بازل على أي طرف متعاقد التزاما مباشرا بكفالة عدم السماح بمغادرة أي شحنة نفايات خطرة إلى أي بلد قام بحظراستيراد تلك النفايات .وخفض توليد النفايات الخطرة إلى الحد الأدنى فأوجبت الاتفاقية على دول الأطراف أتخاذ التدابير اللازمة التي تكفل خفض انتاج توليد النفايات الخطرة الى أدنى حد ممكن. و تقليل حركة النفايات الخطرة عبر الحدود فيمكن القول بأن ذلك النقل لايتم إلا إذا كان الحل الأخير والأمثل من ناحية الابتعاد عن المخاطرة بالبيئة كما ألزمت اتفاقية بازل الأطراف فيها ب : ـ ضمان الإدارة السليمة بيئيا للنفايات الخطرة ويشارك في هذا الالتزام الدولة المصدرة ودول النقل ودولة المستوردة. ـ والالتزام بالحرص على التخلص من النفايات من مكان إنتاجها دون نقلها عبر الحدود وتساهم إتفاقية بازل في مساعدة الدول النامية للتطوير من الوسائل التكنولوجية وتوفير المعلومات.

: Abstract The Basel Convention on the Control of HazardousWastes and TheirTransboundaryDisposalis an agreement concludedin 1989 and enteredinto force in 1992. It primarily deals withprotecting the environmentfrom the harmcaused by hazardouswaste by establishing international obligations to prevent the export of hazardouswaste. Each country has the sovereign right to prohibit the import of hazardouswaste. The Basel Convention imposes a direct obligation on anycontracting party to ensurethat no shipment of hazardouswasteisallowed to leaveany country that has prohibited the import of suchwaste.Reducing the generation of hazardouswaste to a minimum requiresthat States Parties take the necessarymeasures to ensurethat the generation of hazardouswasteisreduced to the lowest possible level. Reducing the movement of hazardouswasteacrossborderscanbesaid to be a last resort, as this transport shouldonlybeundertaken as a last resort and as an optimal solution to avoidenvironmentalrisks :The Basel Convention alsoobligatesits parties to -Ensure the environmentallysound management of hazardouswastes.
