آثار اتفاق التحكيم التجاري الدولي

Abstract

يعتبر اتفاق التحكيم التجاري الدولي عقد من نوع خاص وذلك بسبب اختلافه عن باقي العقود، فرغم أنه يخضع لنفس القواعد العامة الإلزامية للعقود، إلا أن الآثار التي تترتب عليه تختلف عن باقي العقود، فاتفاق التحكيم التجاري الدولي يتم باتفاق أطراف عقد التجارة الدولية على وضعه كبند في العقد الأصلي، إلا أنه يكون مستقل وله ذاتية خاصة وذلك لاختلاف موضوعه عن العقد الأصلي ولا يخضع لنفس مصيره في حالة بطلانه، كما يصبح اتفاق التحكيم بصورتيه (شرط التحكيم أو مشارطة التحكيم) ملزم للأطراف بعرض نزاعهم على التحكيم وعدم عرضه على القضاء، وتكون بذلك هيئة التحكيم وحدها المختصة بالفصل في النزاع.

Abstract: The international commercial arbitration agreement isconsidered a special type of contractbecause of itsdifferencefrom the rest of the contracts, althoughitissubject to the samegeneralbindingrules for contracts, but the effectsitentailsdifferfrom the rest of the contracts, as the international commercial arbitration agreement is made by the agreement of the parties to the international tradecontract to place it as a clause in the original contract, but itisindependent and has a specialsubjectivity due to the difference in itssubjectmatterfrom the original contract and is not subject to the same fate in the event of itsinvalidity, and the arbitration agreement in itstwoforms (arbitration clause or arbitration clause) becomesobligatory for the parties to submittheir dispute to arbitration and not submitit to the judiciary, soonly the arbitration court iscompetent to decide in the case of the original contract
