حماية الثروة الغابية في الجزائر

Abstract

تعتبر الثروة الغابية بمواردها الطبيعية من اهم الثروات الطبيعية الوطنية نظرا لأهميتها و وظائفها الحيوية ، تزخر الجزائر بغطاء غابي هام مما دعى بالدولة العمل على حمايته و الحفاظ عليه من مختلف المخاطر التي تهدده ، اتخذت الدولة عدة تدابير و اليات لحماية هذه الثروة الغابي ، بوضع مجموعة من النصوص القانونية اهمها القانون 23 – 21 المتعلق بالغابات و الثروة الغابية، لتحقيق الحماية القانونية الوقائية و التي تهدف الى تثمين و تنمية الثروة الغابية من خلال الحماية القبلية من الحرائق و التصحر و مختلف المخاطر. و ايضا من خلال الاستعمال و الاستغلال الايجابي و العقلاني لهذه الثروة لضمان استمراريتها ، و الحماية الجنائية الردعية و تشمل مختلف التدابير الردعية من جزاءات و عقوبات في حال تجاوز او مساس مضر بالغابات ، يصاحب هذه التدابير تسخير مجموعة من الوسائل و المؤسسات الضبطية القضائية التي تقوم بالتنفيذ بما جاء في مختلف القوانين. الكلمات المفتاحية:حماية الثروة الغابية ، الحماية القانونية للغابات ، الغابات ، الحماية الجزائية ، الترخيص ، المجالات المحمية. Abstract: Forest wealth with its natural resources is considered one of the most important national natural resources due to its significance and vital functions. Algeria is rich in significant forest cover, which has prompted the state to work on protecting and preserving it from various threats. The state has taken several measures and mechanisms to protect this forest wealth by establishing a set of legal texts, the most important being Law 23-21 related to forests and forest wealth, to achieve preventive legal protection aimed at valuing and developing forest wealth through prior protection against fires, desertification, and various risks. Also, through the positive and rational use and exploitation of this wealth to ensure its sustainability, as well as penal deterrent protection which includes various deterrent measures such as penalties and punishments in case of harm or damage to forests. Accompanying these measures are various means and judicial control institutions that are responsible for implementing the provisions of the various laws.
