Abstract

تشكل المفاوضات في عقود التجارة الدولية عملية أساسية لتحديد شروط وأحكام العقد بين الأطراف المتعاملة، حيث تؤثر نتائج هذه المفاوضات بشكل كبير على المسؤوليات القانونية لكل طرف في العقد، فهي تحدد الالتزامات والحقوق التي يجب أن يلتزم بها كل طرف، وتحدد كيفية التعامل مع النزاعات والمسائل القانونية المحتملة، ويتعين على الأطراف الالتزام بالتفاهمات التي تم التوصل إليها خلال عملية المفاوضات، وفي حالة عدم الامتثال، قد تتحمل الأطراف المسؤولية المدنية والتقصيرية.

Abstract Negotiations in international trade contracts constitute a fundamental process for determining the terms and conditions of the contract between the parties involved. The outcomes of these negotiations significantly impact the legal responsibilities of each party in the contract. They define the obligations and rights that each party must adhere to and determine how to handle potential disputes and legal matters. Parties are required to adhere to the agreements reached during the negotiation process, and in case of non-compliance, they may bear civil and tort liabilities.
