جرائم الغابات في التشريع الجزائري

Abstract

نظرا للبعد الاقتصاديوالاجتماعي والبيئي للأملاك الغابية ودورها الفعال في جميع المجالات فقد أحاطها المشرع بحماية جزائية خاصة نص عليها في قانون الغابات وقانون العقوبات والقوانين ذات صلة وطيدة بالغابات خاصة بعد العجز الملحوظ في قواعد المسؤولية الإدارية والمدنية التي أثبتت عدم كفايتها في تحقيق الحماية الوقائية المرجوة، لذلك لجأ المشرع إلى إصدار قانون خاص يتكفل بتحقيق الحماية المرجوة للحفاظ على هذه الثروة من كل أشكال التعدي من أجل الإبقاء على الغابة للأجيال الحالية والقادمة وعززه بآليات إجرائية وموضوعية تهدف إلى تسليط عقوبات ردعية على كل من خالف أو ألحق ضررا بها. الكلمات المفتاحية:الأملاك الغابية، الحماية الجزائية،آليات إجرائية ،آليات موضوعية، تحقيق الردع. Summary: In view of the economic, social and environmental dimension of forestproperties and their effective role in all fields, the legislator has surroundedthemwithspecialpenal protection stipulated in the Forest Law, the Penal Code and lawscloselyrelated to forests, especiallyafter the noticeabledeficiency in the rules of administrative and civil responsibilitywhich have proveninsufficient in achieving the desiredpreventive protection. Therefore The legislatorresorted to issuing a speciallaw to ensure the desired protection to preservethiswealthfrom all forms of encroachment in order to preserve the forest for future generations, and strengtheneditwithprocedural and substantive mechanismsaimedatimposingdeterrent penalties on anyonewhoviolates or causes harm to it.
