Abstract

This study aimed to address the issue of whether Algerian legislation provides an adequate legal framework for the establishment and development of start-ups. It reviewed the most prominent supporting and accompanying institutions, such as the Ministry of Start-ups, which has sought to keep pace with global transformations through the issuance of specialized regulatory texts, notably Executive Decree No. 20-254 and Executive Decree No. 21-422, as well as the amendment of the Commercial Code under Law No. 22-09. These measures granted start-ups a clear legal status, accompanied by the creation of a dedicated ministry and the National Committee for the "Start-up" label. In addition, the support system was enhanced through business incubators and specialized funding agencies. The study, through theoretical and analytical analysis, concluded that the Algerian legislator has taken serious steps in this direction. However, the legal framework still needs to be more effectively implemented and integrated with the economic and institutional environment. One of the key findings is that the success and sustainability of start-ups in the market depends largely on the effectiveness of institutional and financial support mechanisms.
