أليات مكافحة جريمة التجسس الإلكتروني في التشريع الجزائري

Abstract

أدى التطور السريع والانتشار غير المسبوق للتكنولوجيا الحديثة خاصة في المجال الرقمي إلى إحداث تغير جوهري في نمط وطرق ممارسة الدول لأنشطتها وتسيير مرافقها بتدرج مستويات أهميتها وحساسيتها مما ألزم الدول إلى تبني الاستراتيجية الرقمية في الإدارة والاعتماد بشكل أساسي على انظمة المعالجة الآلية للمعطيات في معالجة مختلف بيانتها و معلوماتها حتى السرية منها مما تولد عن ذلك تغيير طرق الاعتداء على هذه المعلومات متحولة بفعل تأثير الثورة المعلوماتية إلى طرق إلكترونية تتماشى مع الأساليب الحديثة في حفظ الأسرار فظهر بذلك التجسس الإلكتروني في البيئة الإلكترونية كنشاط موازي للتجسس التقليدي في البيئة العادية ونظرا لخصوصية البيئة الجديدة التي يرتكب فيها هذا النشاط فإن الطرق والأليات التقليدية لمكافحة التجسس أصبحت عاجزة في أغلبها على مواكبة التغيير الحاصل باعتبار أن السلوك الإجرامي ووسيلة ارتكابه و البيئة التي يتم على مستواها أخذت شكل إلكترونيا غير محسوس مع عدم القدرة على التحديد الدقيق للأضرار الحاصلة وبناءا على ما سبق كانت هذه الدراسة محاولة للإحاطة بجميع جوانب جريمة التجسس الإلكتروني وكذا محاولة رصد الجهود المبذولة لمكافحتها من خلال الأليات الموضوعية والإجرائية التي تيناها المشرع الجزائري في ظل الطفرة المعلوماتية التي يشهدها العالم . الكلمات المفتاحية : جريمة التجسس الإلكتروني، الآليات الموضوعية ، الآليات الإجرائية، البيئة الرقمية، الثورة المعلوماتية . Abstract: The and rapid development unpercedented spread of moderntechnology, especially in the digital field. This has necessitated the adoption of digital strategies in administration relying heavily on automated data processing systems to handle different types of data and information including confidential ones. As a result, the methods of attacking this information have evolved due to the influence of the information revolution. Transforming into electronic methods that align with modern ways of keeping secrets. Thus. electronic espionage has emerged in the digital environment. given the unique nature of the new environment in which this activity occurs, traditional methods and mechanisms for combating espionage have largely become inadequate to keep pace with the ongoing changes, this is because the criminal behavior the means of its commission and the environment in which it takes place have all taken on an intangible electronic form making it difficult to precisely determine the resulting damages based on the above this study attempts to encompass all aspects of the crime of electronic espionage and to monitor the efforts made to combat it through the substantive and procedural mechanisms adopted by the Algerian legislator in light of the information boom the world is witnessing.
