المسؤولية الجنائية في الجرائم البنكية

Abstract

لقد تناولنا في هذه الرسالة المختصرة موضوع المسؤولية الجنائية في الجرائم البنكية، حيث تم في الفصل الأول تسليط الضوء على الإطار المفاهيمي لهذه الجرائم، مع توضيح خصائصها وتمييزها عن غيرها من الأفعال الإجرامية ذات الطابع المالي، وكذا استعراض أبرز العوامل المساهمة في تفشيها، سواء كانت تنظيمية أو تقنية.أما الفصل الثاني فقد خُصص لدراسة الآليات الزجرية (الجزائية) المعتمدة لمواجهتها، من خلال تحليل الإطار القانوني المنظم لها، واستعراض العقوبات المقرّرة والهيئات المتداخلة في التصدي لها، في ظل التحديات التي تفرضها طبيعة هذه الجرائم وتعقيداتها.ويبرز من خلال هذه الرسالة الطابع الخاص لهذه الجرائم، وأهمية إرساء التوازن بين الوقاية والمساءلة الجزائية، لضمان نجاعة النظام البنكي وحمايته. الكلمات المفتاحية: الإطار المفاهيمي، خصائص كل جريمة، العوامل المساهمة، الإطار القانوني المنظم، العقوبات المقررة، الهيئات المتدخلة. Abstract: This concise dissertation addresses the issue of criminal liability in banking crimes. The first chapter sheds light on the conceptual framework of these crimes, clarifying their characteristics and distinguishing them from other financially motivated criminal acts. It also examines the main factors contributing to their proliferation, whether organizational or technical. The second chapter is devoted to studying the punitive (penal) mechanisms adopted in Algeria to confront these offenses, through an analysis of the relevant legal framework, a review of the prescribed penalties, and the roles of the institutions involved in combating them—considering the challenges posed by the nature and complexity of such crimes. This study highlights the distinctive nature of banking crimes and underscores the importance of establishing a balance between prevention and criminal accountability in order to ensure the effectiveness and protection of the banking system.
