منازعات الدفتر العقاري في القانون الجزائري

Abstract

نهدف من خلال هذه الدراسة إلى توضيح المنازعات التي يثيرها الدفتر العقاري، فكان لابد من الوقوف على الإطار المفاهيمي للدفتر العقاري وهذا من خلال تعريفيه وطبيعته القانونية باعتباره قرارا إداري أو عقد إداري، وكذلك توضيح الإجراءات التحضيرية والقانونية التي يقوم عليها هذا الاخير. كما يكمن الهدف الرئيسي في إبراز أهم المنازعات التي يمكن أن تثار بشأن هذا السند والجهات القضائية المختصة بالفصل في كل نزاع. Abstract : Through this study, we aim to clarify the disputes raised by the real estate booklet. It was necessary to understand the conceptual framework of the real estate booklet, through its definition and legal nature as an administrative decision or an administrative contract, as well as clarifying the preparatory and legal procedures on which the latter is based. The main goal also lies in highlighting the most important disputes that could arise regarding this document and the judicial authorities competent to decide each dispute.
