حدود الحماية الجنائية لحق المؤلف

Abstract

يعتبر حقوق المؤلف من أهم حقوق الملكية الفكرية كونها تمثل الإبداع الفكري و الذهني، لذلك عملت التشريعات الوطنية و الاتفاقيات الدولية على حماية المصنفات أيا كان نوعها أو طريقة التعبير عنها و ذلك من خلال حماية حقوق مؤلفها المعترف به سواء كانت أدبية أو مالية. فحق المؤلف هو من بين الحقوق التي تستهدف حماية كبيرة لما كان لها من أهمية على صاحبها، و التي تعتبر جوهر حق التأليف، و حق المؤلف يتعرض يوميا إلى اعتداءات و قد تطورت أساليب المساس بهذه الحقوق، لذلك تدخل المشرع الجزائري بتحديد مجال الحقوق المحمية، و إقراره طرق حمايتها سواء كانت الحماية الوقائية من خلال الحماية الإجرائية أو الإدارية، أو عن طريق إقرار حماية قضائية عن طريق الحماية القضائية عن طريق الدعوى المدنية أو الدعوى الجزائية و ذلك بنص القانون المتمثل في الأمر رقم 03-05 المتعلق بحماية حقوق المؤلف. الكلمات المفتاحية :حقوق المؤلف، الملكية الفكرية، الدعوى المدنية، الدعوى المدنية.
