الآليات القانونية لمكافحة جرائم العملة في التشريع الجنائي الجزائري

Abstract

تهدف الدراسة إلى الكشف عن الآليات القانونية في التشريع الجزائري والجهات المخولة لمكافحة جرائم العملة وتتمثل في وضع تلك القواعد الإجرائية والعقابية التي لا مناص أن لها وزنها وفعاليتها في مواجهة الجرائم الواقعة على العملة حيث اعتمدنا في الدراسة المنهج الوصفي والتحليلي وذلك من خلال وصف ما جاء في القوانين التشريعية الجزائرية وتحليل مضمون تلك النصوص والمواد حسب ما جاءت به التشريعات المنظمة لها. وتكمن أهمية الموضوع في كونه جدير بالبحث والدراسة لأن العملة عامل أساسي للتحولات الاقتصادية والاجتماعية والسياسية هذا من الناحية العلمية، أما من الناحية العملية فيجب حماية العملة جزائيا كونها لها تأثير على الاستقرار والثقة في الدولة.

Abstract The studyaims to reveal the legalmechanisms in the Algerian legislation and the authoritiesauthorized to combat currency crimes and is to developthoseprocedural and punitive rulesthatinevitably have theirweight and effectiveness in the face of crimes against the currency, whereweadopted in the study the descriptive and analyticalapproach by describingwhatwasstated in the Algerian legislativelaws and analyzing the content of thosetexts and articles according to what came by the legislationregulatingthem. The importance of the topic lies in the factthatitisworthresearching and studyingbecause the currencyis a key factor for economic, social and political transformations from a scientific point of view, but in practice the currency must beprotectedcriminally as it has an impact on stability and confidence in the state.
