المحافظة العقارية كأداة للشهر العقاري

Abstract

تُعدالمحافظة العقارية جهازًا إداريًا وقانونيًا لها دور محوري في نظام الشهر العقاري، حيث تتولى مهمة مسك وتسيير السجلات العقارية التي تُوثق فيها جميع التصرفات القانونية والعينية التي ترد على العقارات. ويهدف هذا النظام إلى ضمان العلنية واعطاء الحجية القانونية للتصرفات العقارية، وترسيخ مبدأ الإئتمان العقاري، من خلال حماية حقوق المالكين والمتعاملين على العقارات. حيث تلعب المحافظة العقارية دور الوسيط بين الإدارة العامة والخواص، فهي تقومبشهر التصرفات الواردة على العقار بعد التأكد من صحتها واستيفائها للشروط القانونية. وذلك لمنح التصرفات العقارية طابعًا رسميًا وشرعيًا يجعلها نافذة في مواجهة الغير، ويمنع النزاعات المتعلقة بالملكية. وبذلك، تُعد المحافظة العقارية أداة أساسية في تفعيل نظام الشهر العقاري، وضمان استقرار المعاملات العقارية، وخلق بيئة قانونية آمنة للاستثمار العقاري، وتثبيت الحقوق بطريقة رسمية وقانونية.

ABSTRACT : The Real EstateGovernorateis an administrative and legaldevicethat has a pivotalrole in the real estateregime, as ittakes charge of holding and conducting real estate records in which all legal and in -kind actions are documented to real estate. This system aims to ensurepublicity, givelegalauthenticity to real estate actions, and to consolidate the principle of real estatecredit, by protecting the rights of owners and dealers on real estate. Where the Real EstateGovernorateplays the role of the mediatorbetween the public administration and the properties, itplays the month of the actions received on the propertyafterverifyingitsvalidity and fulfilling the legal conditions. This is to give real estate actions an official and legitimate nature thatmakesitwindow in the face of others, and prevents disputes related to ownership. Thus, the real estate province is an essential tool in activating the real estateregime, ensuring the stability of real estate transactions, creating a safelegalenvironment for real estateinvestment, and installingrights in an official and legalway.
