رخصة البناء كآداة للتعمير في التشريع الجزائري

Abstract

إن رخصة البناء من أهم القرارات الإدارية التي تصدرها الادارة للتحكم في التطور العمراني وذلك من خلال احترام القوانين والمراسيم الصادرة في هذا المجال، وعند انتهاك هذه القوانين كفل المشرع الجزائري لقاء ذلك حق اللجوء إلى القضاء لتسوية النزاعات سواء بتدخل القضاء العادي أو القضاء الاداري بحسب اختلاف موضوع الدعوة أو الاجراءات أو أطراف النزاع الكلمات المفتاحية : قانون التهيئة والتعمير ، رخصة البناء، منازعات رخصة البناء.

The building permit is one of the most important administrative decisionsissued by the administration to control urbandevelopment by respecting the laws and decreesissued in thisfield, and whentheselaws are violated, the Algerian legislatorguaranteed in return the right to resort to the judiciary to settle disputes, whetherwith the intervention of the ordinaryjudiciaryor the administrative judiciary, according to the differentsubject of the invitation, procedures or parties to the dispute.
