إلتزامات الأطراف في عقد التجارة الإلكترونية

Abstract

يترتب عن تنفيذ العقد الإلكتروني في التجارة الإلكترونية، أثر و الذي يشمل التزامات تقع على أطراف العلاقة العقدية، ألا و هما المورد الإلكتروني و المستهلك الإلكتروني، التي تخضع في أحكامها للمبادئ العامة مع بعض الخصوصية، والتي نضمها المشرع الجزائري في قانون رقم 18-05 المتعلق بالتجارة الإلكترونية، الذي يهتم بتنظيم معاملات التجارة الإلكتروني وقد سلط هذا البحث الضوء على أهم الإلتزامات التي تقع على المورد الإلكتروني، و المستهلك الإلكتروني، و الجزاءات المترتبة عن إخلالهم بإحداها، والتي تخضع للعقد بصفة عامة و عقد البيع الإلكتروني بصفة خاصة. الكلمات المفتاحية: أثار العقد الإلكتروني- إلتزامات أطراق عقد التجارة الإلكترونية- المورد الإلكتروني -المستهلك الإلكتروني. Summary: The performance of an electronic contract in electronic commerce has an effect and includes obligations incumbent upon the parties to the contractual relationship, namely, the electronic supplier and the electronic consumer, which in their provisions are governed by general principles with some privacy,and which are enshrined in Algerian legislation in Act No. 18_05 on electronic commerce, which deals with the regulation of electronic commerce transactions.
