الضمانات القانونية لجذب الاستثمار الاجنبي في التشريع الجزائري

Abstract

تشكل الإستثمارات الأجنبية في الوقت الراهن من أهم الوسائل التي هدفها تحقيق التنمية الإقتصادية والإجتماعية للدول السائرة في طريق النمو، كما أنها تمثل أداة فعالة في نقل المعرفة والتكنولوجيا العلمية، ولهذا قام المشرع الجزائري بسن مجموعة من القوانين التي تنص على الضمانات القانونية لجذب المستثمر الأجنبي ولحمايته من المخاطر التي تعرقل مشروعه الإستثماري، وهذه الضمانات تتمثل في الضمانات الموضوعية كضمانات عامة والتي جاء فيها ضمان المعاملة العادلة والمنصفة والثبات التشريعي وحماية ملكية المشروع الإستثماري وحقوق الملكية الفكرية وأخرى مالية التي جاء فيها أيضا ضمان الإستفادة من العقار وحرية تحويل رؤوس الأموال وكذا ضمان الإعفاء من التجارة الخارجية والتوطين البنكي إضافة إلى الضمانات الإجرائية والتي تحتوي على ضمانات قضائية لفض النزاعات ومنها القضاء الوطني كأصل والتحكيم التجاري كإستثناء في حالة وجود إتفاقية تقضي بذلك، وضمانات إدارية تتمثل في تطوير وتحسين الإجراءات الإدارية بالإضافة إلى إستحداث أجهزة مكلفة بترقية الإستثمار كالوكالة الجزائرية لترقية الإستثمار والمجلس الوطني للإستثمار واللجنة الوطنية العليا للطعون، وكل هذه الضمانات التي كرسها المشرع الجزائري من أجل خلق بيئة إستثمارية مناسبة لإستقطاب الإستثمارات الأجنبية. الكلمات المفتاحية:الضمانات، التنمية الاقتصادية، إستقطاب، الإستثمارات الأجنبية.
