عقد تطوير المدينة في القانون الجزائري

Abstract

عملت الجزائر على فتح المجال أمام القطاع الخاص سواء كان أجنبي أو وطني في مجال التنمية وذلك من اجل تخفيف العبء المالي على الدولة في تمويل المشاريع وتسييرها، وفي ظل هذه التشاركية، فقد قامت الجزائر بالعديد من عقود الشراكة مع القطاع الخاص ضمن عقود تطوير المدينة في مجالات مختلفة كقطاع النقل والمواصلات والمياه البنية التحتية والمساحات الخضراء، غير أن الجزائر لم تحقق الغاية المرجوة من هذه العقود مقارنة مع باقي الدول، نظرا للمناخ غير مناسب ونفور المستثمرين الأجانب من الاستثمار بسبب البيروقراطية الإدارية وفساد الإدارة الجزائرية كالرشوة، عدم وجود تحفيز للمستثمر. وخلصت دراستنا إلى أن عقود تطوير المدينة تحتاج إلى مناخ ملائم، من تنظيم تشريعي ومؤسساتي ووعي عام بأهمية هاته الإستراتيجية للوصول للتنمية المستدامة في مجال البنية التحتية والمرافق العامة. الكلمات المفتاحية: القطاع العام، القطاع الخاص، عقود الشراكة بين القطاعين، المشاريع العمرانية، المدينة، التنمية المستدامة. summary Algeria has worked to open the way for the private sector, whether foreign or national, in the field of development in order to reduce the financial burden on the state in financing and managing projects. In light of this partnership, Algeria has entered into many partnership contracts with the private sector within city development contracts in the areas of Different sectors, such as the transportation sector, water, infrastructure, and green spaces, but Algeria did not achieve the desired goal of these contracts compared to other countries, due to the unsuitable climate and the aversion of foreign investors from investing due to administrative bureaucracy, corruption of the Algerian administration such as bribery, and lack of incentive for the investor. Our study concluded that city development contracts require an appropriate climate, including legislative and institutional regulation and public awareness of the importance of this strategy to achieve sustainable development in the field of infrastructure and public facilities.
