المسؤولية القانونية عن تصرفات الروبوت التاجر

Abstract

يعتبر الروبوت التاجر تطبيق من تطبيقات الذكاء الإصطناعي، الذي أصبح يفرض نفسه في واقعنا، بحيث يتدخل في مختلف مجالات الحياة، بما فيها النطاق التجاري بصفة خاصة ولمدى الأهمية التي يتمتع بها التاجر الآلي لما له من دور في تسهيل المعاملات التجارية، هذا ما أدى لإنقسام الفقهاء حول مدى إمكانية منح الروبوت التاجر الشخصية القانونية من عدمها، إلا أن هناك توجه جديد يستدعي بوجوب منح شخصية قانونية ثالثة للروبوت التاجر تسمى بالشخصية الإفتراضية، هذا الجانب المشرق للذكاء الإصطناعي قد يثير معوقات قانونية تتعلق بالمسؤولية الناتجة عن أعماله بنوعيها المدنية و الجزائية عن كل فعل ضار قد يسببه هذا الروبوت للغير . الكلمات المفتاحية : الذكاء الإصطناعي، الروبوت التاجر، التاجر الآلي، الشخصية الإفتراضية، المسؤولية المدنية، المسؤولية الجزائية . Abstract: The merchant robot is an application of artificial intelligence (AI), which has become increasingly prevalent in our reality, intervening in various areas of life, particularly in the commercial sphere. Given the importance of the robot merchant due to its role in facilitating commercial transactions, this has led to a division among jurists over the possibility of granting the merchant robot legal personality. However, a new trend calls for granting the merchant robot a third legal personality, called (in effect) a virtual personality. This bright side of AI may raise legal obstacles related to liability resulting from its actions, both civil and criminal, for any harmful act this robot may cause to others.
