النظام القانوني للمحكمة التجارية المتخصصة

Abstract

توجه المشرع الى استحداث المحكمة التجارية المتخصصة من خلال اصداره لقانون 22-13 المعدل والمتمم للقانون 08-09 المتضمن قانون الاجراءات المدنية و الادارية، حيث أن هذه المحكمة تتشكل من قاض و4 مساعدين يكون لهم رأي تداولي ذلك بتحديد شروط وكيفيات اختيارهم من خلال المرسوم التنفيذي 23-52، كما تختص بالفصل في المنازعات التجارية التي حددت في المادة 536 مكرر من القانون 22-13، أما الاختصاص الاقليمي يقتضي الرجوع الى أحكام قانون الإجراءات المدنية و الإدارية اضافة الى ذلك حدد عدد هذه المحاكم ب 12 محكمة طبقا للمادة 2 من المرسوم التنفيذي 23-53، بينما في سير الخصومة فقد فرض الصلح كاجراء سابق لقيد الدعوى أمام هذه المحكمة واذا فشل هذا الاجراء ترفع الدعوى بالطرق المعتادة مع ارفاقها بمحضر عدم الصلح، تنتهي هذه الخصومة بحكم قابل للاستئناف وذلك أمام المجلس القضائي . الكلمات المفتاحية :المحكمة التجارية المتخصصة، المنازعات التجارية،الصلح . Abstract The legislator decided to create the Specialized Commercial Court by issuing Law 22-13 amending and supplementing Law 08-09 containing the Civil and Administrative Procedures Law, as this court is composed of a judge and 4assistants who have a deliberative opinion by determining the conditions and modalities of their selection through Executive Decree 23-52, as well as adjudicating the disputes specified in Article 536 bis of Law 22-13 Regional jurisdiction requires referring to theprovisions of the Civil and Administrative Procedures Law. In addition, the number of these courts was limited to 12 courts in accordance with Article 2 of the decree. Executive 23-53, while in the course of the dispute, reconciliation was imposed as a procedure prior to registering the lawsuit before this court. If this procedure fails, the lawsuit is filed in the usual ways and attached to a report of non-conciliation, this dispute ends with an appealable ruling before the Judicial Council.
