Abstract

تتمثل الأجهزة القانونية لتأطير الاستثمار في ظل القانون الجديد رقم22-18، في الوكالة الجزائرية لترقية الاستثمار التي حلت محل الوكالة الوطنية لترقية الاستثمار المنشأة بموجب أحكام المادة 6 من الأمر رقم 01-03 مؤرخ في 20 أوت 2001 يتعلق بتطوير الاستثمار ملغى، تتمتع بمهام وصلاحيات واسعة، سواء في مجال الإعلام، والتسهيل على المستثمرين على طريق المنصة الرقمية، أو في مجال ترقية الاستثمار والمبادرة بكل نشاط مع الهيئات العمومية، ومرافقة المستثمر عن طريق التوجيه والتكفل بالمستثمرين، وكذا في مجال تسيير الامتيازات وإجراءات المتابعة. وفي المجلس الوطني للاستثمار المنشأ بموجب أحكام الأمر رقم 01-03 الملغى وتم الإبقاء عليه في ظل القانون الجديد، يتمتع بسلطات محددة وهي اقتراح إستراتيجية الاستثمار، وتنسيقها والعمل على تنفيذها، وبعد تقريرا سنويا يرفعه لرئيس الجمهورية بوضع لدى الوزير الأول أو رئيس الحكومة حسب الحالة. الكلمات المفتاحية: المستثمر، صلاحيات، الاستثمار، القانون، المهام .

Abstract : The legal bodies for investment supervision under the new law No18-22 are represented in the Algerian agency for investment promotion, which replaced the national agency for investment promotion established under the provisions of article 06 of ordinance N03-01 august 20.2001 relating to the development of investment, repealed, It has wide tasks and powers, both in the field of information, and facilitation for investors through the digital platform, or in the field of investment promotion and initiating every activity with public bodies, and accompanying the investor by directing and sponsoring investors, as well as in the field of managing concessions and follow-up procedures. And in the national investment council, which was established under the provisions of order N 01-03, which was canceled and was maintained under the new law, it has specific powers, which are proposing the investment strategy, coordinating it and working on its implementation, and preparing an annual report to be submitted to the president of the placed with the prime minister or the prime minister, as the case may be.
