حماية اراضي الدولة في ظل القانون 23-18 المتعلق بحماية أراضي الدولة و المحافظة عليها

Abstract

وكخلاصة لمذكرننتنا فان القانون 23-18 قد تم سنه بناءا على معاينات للسلطات العليا للبلاد على ما آل اليه وضع اراضي الدولة التابعة للاملاك الوطنية العمومية والخاصة التي تملكها الدولة وجماعاتها الاقليمية، التي استبيحت من طرف المعتدين، حيث اقيمت عليها احياء ضخمة على هوامش المدن و طالت تقريبا كل بلديات الوطن، ولم تفلح القوانين السابقة في تامين حماية هذه الاملاك، خاصة مع تنامي ظاهرة النهب، واتخاذها مصدرا للثراء من طرف مافيا العقار، امام تهاون او تواطؤ بعض الموظفين، مما دعا السلطات العليا في البلاد الى سن هذا القانون لتعزيز الترسانة القانونية، واستكمال النصوص التشريعية السارية، واعطاء نفس جديد في سبيل استرجاع اراضي الدولة، سواء من خلال عمليات الاسكان السابقة، او من خلال تطبيق هذا القانون. Abstracts As a summary of our memorandum, Law 23-18 was enacted based on inspections of the country's higher authorities on the status of state lands belonging to public and private national properties owned by the state and its regional groups, which were abused by the aggressors, where huge neighborhoods were established on the margins of cities and affected almost all municipalities of the country, and previous laws did not succeed in securing the protection of these properties, especially with the growing phenomenon of looting, and taking it as a source of wealth by the real estate mafia, in front of complacency or complicity. Some employees, which called on the highest authorities in the country to enact this law to strengthen the legal arsenal, complete the legislative texts in force, and give a new breath in order to recover state land, whether through previous housing operations, or through the application of this law.
