النظام القانوني لعقد المقاولة في التشريع الجزائري

Abstract

لقد تطرقنا في بحثنا هذا إلى حقيقة عقد المقاولة الذي يعتبر من العقود المسماة الواردة في عقود العمل وأيضا تناولنا الفرق بينه وبين العقود المشابه له. ومن خلال نجد أن عقد المقاولة لديه دور كبير في الحياة الغجتماعية لهذا وجب عن المشرع الجزائري تنظيمه وفقا لأحكام ونصوص قانونية التي تسيره وتضبط مفاهيمه وأطرافه وهذا وفقا لأحكام القانون المدني من مادة 549 إلى 570. فعقد المقاولة مثله مثل العقود يخضع للقواعد العامة للعقد بدءً تنفيذه أو حتى قبل تنفيذه إلى إنقضاءه. الكلمات المفتاحية: عقد المقاولة – العقود- الإلتزامات- المقاول- رب العمل- المشرع الجزائري.

Summary:

In this research, we have touched upon the fact of the contracting contract, which is one of the named contracts contained in the employment contracts, and also addressed the difference between it and similar contracts. Therefore, the Algerian legislator must regulate it in accordance with the provisions and legal texts that govern it and regulate its concepts and parties, and this is in accordance with the provisions of the civil code from articles 549 to 570. The contracting contract, like the contracts, is subject to the general rules of the contract from the beginning of its execution or even before its execution until its expiration.
