الغاء الترقيم العقاري أمام القضاء الإداري في التشريع الجزائري

Abstract

تتناول هذه الدراسة موضوع الترقيم العقاري كآلية قانونية تهدف إلى تثبيت الملكية العقارية وتكوين السجل العقاري الرسمي في الجزائر. وقد ركزت على الجوانب الإجرائية والإدارية المرتبطة بعملية الترقيم، مع تسليط الضوء على المنازعات التي قد تنشأ عنها، خاصة أمام القضاء الإداري. كما تطرقت إلى التحقيق العقاري كوسيلة إثبات، ودور الجهات القضائية المختصة في الفصل في هذه المنازعات. وتوصلت الدراسة إلى أن ضمان الأمن العقاري يتطلب احترام الإجراءات القانونية وتفعيل الرقابة القضائية الفعالة. وانتهت بجملة من المقترحات لتحسين نظام الترقيم العقاري، منها التكوين المتخصص، الرقمنة، وتبسيط إجراءات الطعن. Abstract : This studyaddresses the topic of land registration as a legalmechanismaimed at securingpropertyrights and establishing the official land registry in Algeria. It focuses on the procedural and administrative aspects of the registration process, highlighting disputes thatmay arise, particularlybefore the administrative courts. The studyalso explores the role of cadastral investigation as a method of proof and the jurisdiction of competent courts in resolvingsuch disputes. The findingssuggestthatensuringpropertysecurityrequiresadherence to legalprocedures and the effective oversight of the judiciary. The studyconcludeswithseveralrecommendations to improve the land registration system, includingspecialized training, digitalization, and the simplification of appealprocedures.
