دور أساليب البحث و التحري المستحدثة في الكشف عن جرائم الفساد

Abstract

يتناول هذا البحث دراسة الآليات التي أقرها المشرع الجزائري في كل من قانون الوقاية من الفساد ومكافحته، وقانون الإجراءات الجزائية، وذلك بهدف التصدي لظاهرة الفساد التي باتت تهدد أمن واستقرار المجتمعات. وقد تم التطرق إلى الأساليب التقليدية المعتمدة في كشف جرائم الفساد، إلى جانب تسليط الضوء على الأساليب المستحدثة التي فرضها التطور في أنماط الجريمة وأساليبها. ومن هذا المنطلق، أصبح من الضروري على المشرع تطوير وتفعيل وسائل تحرٍّ تتماشى مع هذا التطور، بل وتسبقه، لضمان عدم إفلات الجناة من قبضة العدالة. الكلمات المفتاحية:الفساد، أساليب التحري، المكافحة، الضبط القضائي، الإجراءات، التحقيق. Abstract This research focuses on examining the mechanisms established by the Algerian legislator in both the Law on the Prevention and Fight against Corruption and the Code of Criminal Procedure, with the aim of addressing the phenomenon of corruption, which has increasingly become a threat to the security and stability of societies. The study discusses traditional methods used in detecting corruption crimes, while also highlighting the modern investigative techniques that have emerged in response to the evolving nature of criminal activity. In this context, it has become essential for the legislator to develop and implement investigative methods that keep pace with, and even stay ahead of, criminal advancements to ensure that perpetrators do not escape justice.
