النظام القانوني لتسيير المساحات الخضراء في التشريع الجزائري

Abstract

تتناول هذه الدراسة موضوع تسيير المساحات الخضراء في التشريع الجزائري، حيث تسعى إلى تحليل الإطار القانوني الناظم لهذه المساحات الحيوية وآليات حمايتها. تكتسي هذه الدراسة أهمية بالغة في ظل التحديات البيئية المعاصرة والضرورة الملحة للحفاظ على التوازن البيئي في المدن الجزائرية. تنقسم الدراسة إلى فصلين رئيسيين: الأول يركز على الإطار القانوني العام للمساحات الخضراء، والثاني يتناول الآليات القانونية لحماية المساحات الخضراء . من خلال هذا التحليل، تهدف الدراسة إلى الكشف عن مدى فعالية التشريع الجزائري في تسيير هذه المساحات وتحديد الثغرات القانونية الموجودة واقتراح الحلول المناسبة. ABSTRACT: This study addresses the issue of green space management in Algerian legislation, seeking to analyze the legal framework governing these vital spaces and the mechanisms for their protection. This study is of great importance in light of contemporary environmental challenges and the urgent need to maintain ecological balance in Algerian cities. The study is divided into two main chapters: the first focuses on the general legal framework for green spaces, and the second addresses the legal mechanisms for protecting green spaces. Through this analysis, the study aims to reveal the effectiveness of Algerian legislation in managing these spaces, identify existing legal loopholes, and propose appropriate solutions.
