الضمانات القانونية لتشجيع الإستثمار في ظل القانون رقم 22-18

Abstract

شهدت الجزائر منذ الاستقلال صدور عدة قوانين لتنظيم الاستثمار، تماشيا مع الدساتير المتعاقبة، غير أن هذه الأطر التشريعية أبانت عن جملة من النقائص والثغرات، ما استدعى إعادة النظر في التوجه الاقتصادي بشكل عام، والاستثماري بشكل خاص، تماشيا مع ما نص عليه دستور نوفمبر 2020. وقد تم ذلك من خلال مراجعة الإطار القانوني ومحاولة تهيئة بيئة استثمارية أكثر جاذبية لاستقطاب رؤوس الأموال. وتعد التشريعات المتعلقة بالاستثمار إحدى الأدوات الأساسية التي تعتمدها الدولة لتحفيز الاستثمار، عبر تقديم ضمانات قانونية وحوافز مالية تساهم في خلق مناخ مناسب للمستثمرين. وتهدف هذه الورقة البحثية إلى تسليط الضوء على أبرز الضمانات التي تضمنها قانون الاستثمار رقم 22-18، الصادر في ظل حاجة ملحة إلى إنعاش الاقتصاد الوطني واستعادة ثقة المستثمرين، من خلال ما يوفره من حقوق وامتيازات وحوافز مالية، فضلا عن استحداث آليات جديدة لتأطير وتشجيع الاستثمار. وتخلص الدراسة إلى أن القانون الجديد أقر جملة من الضمانات والامتيازات، من بينها إعادة هيكلة أنظمة التحفيز وتوجيهها نحو القطاعات ذات الأولوية، مع تعزيز مهام الترويج والمرافقة للمستثمرين. الكلمات المفتاحية:الاستثمار، الضمانات، التحفيز، تشجيع الاستثمار. Abstract Since gaining independence, Algeria has enacted several laws to regulate investment in line with successive constitutions. However, these legal frameworks have revealed various shortcomings and gaps, prompting a reconsideration of the country's overall economic and investment strategies, particularly in light of the provisions of the November 2020 Constitution. This has involved revising the legal framework and striving to create a more attractive investment environment to draw in capital. Investment legislation is considered one of the state's key tools to promote investment by offering legal guarantees and financial incentives that help establish a favorable climate for investors. This research paper aims to highlight the main guarantees introduced by Investment Law No. 22-18, enacted amid an urgent need to revive the national economy and restore investor confidence. The law does so by granting rights, privileges, and financial incentives, as well as by introducing new mechanisms to regulate and encourage investment. The study concludes that the new law provides several guarantees and benefits, including the restructuring of incentive schemes and directing them toward priority sectors, along with strengthening promotional and support roles for investors.
