آليات مكافحة الجرائم الإلكترونية في التشريع الجزائري

Abstract

ملخص: تعتبر الجرائم الالكترونية من الجرائم التي نشأت حديثا وتستهدف بشكل رئيسي البيانات والمعلومات والبرامج بأنواعها المختلفة، ويرتكب هذه الجرائم مجرمون ذو ذكاء عالي ويمتلكون المعرفة التقنية والفنية اللازمة، كما تطرح الجريمة الالكترونية العديد من الإشكاليات على مستوى القانون الإجرامي حيث يصعب على المحققين إجراء التحقيقات وجمع البيانات والأدلة الرقمية بإستخدام الإجراءات التقليدية مثل المعاينة والتفتيش وضبط الأدلة، من هذا المنطق قام المشرع الجزائري بإصدار آليات قانونية إجرائية وآليات موضوعية للحد من هذه الجريمة الالكترونية وكذا وضع آليات مؤسساتية متخصصة في البحث والتحري عن الجريمة الالكترونية، تعتبر هذه الآليات غير كافية لمواجهة هذه الجريمة العابرة للحدود إذ تتطلب توافر جهود دولية تجسدت في التعاون الدولي، وقد اعتمدنا في هذا البحث عن المنهجين التحليلي والوصفي وتوصلنا إلى نتائج مفادها أن المجرم المعلوماتي يختلف عن المجرم التقليدي، إذ يمتلك علما وكفاءة عالية، بالإضافة إلى قدرات عقلية وذهنية تمكنه من الإفلات من العقاب، كما أن آليات المكافحة الحالية غير كافية لمواجهة الجريمة الالكترونية بفاعلية. الكلمات المفتاحية: الجريمة الالكترونية، المجرم المعلوماتي، الآليات القانونية والاجرائية. Abstract: Cyber crimes are considered crimes that have arisen recently and mainly target data, information and programs of various types. These crimes are committed by highly intelligent criminals who possess the necessary technical and artistic knowledge. Cybercrime poses many problems at the level of procedural law, as it is difficult for investigators to conduct investigations and collect digital evidence using traditional procedures such as inspection, inspection, and seizure of evidence. From this standpoint, the Algerian legislator has issued procedural legal mechanisms and substantive mechanisms to reduce this electronic crime, as well as established institutional mechanisms specialized in research and investigation of electronic crime. These mechanisms are considered insufficient to confront this cross-border crime, as it requires the availability of international efforts embodied in cooperation. In this research, we have relied on the analytical and descriptive approaches and we have reached results that indicate that the information criminal differs from the traditional criminal, as he possesses high knowledge and competence, in addition to mental and intellectual abilities that enable him to escape punishment.
