Abstract

لرخصة التجزئة مكانة خاصة ضمن عقود التعمير لما لها من أهمية في تحديد حقوق البناء على القطع الأرضية محل التجزئة والربط بمختلف الشبكات في إطار عملية التهيئة التي تتطلبها تجزئة الوحدة العقارية، حيث تمر رخصة التجزئة بمجموعة من المراحل السابقة على وجود القرار المتضمن رخصة التجزئة من إيداع طلب والتحقيق فيه ، وإجراءات أخرى لاحقة من تسليم رخصة التجزئة ومراقبة أشغال التهيئة ومن ثمة تسليم شهادة قابلية الاستغلال التي تسمح لصاحب رخصة التجزئة بعد شهرها بالسجل العقاري بالتصرف في الوحدات العقارية بالبيع والكراء ، كما يهدف شهر رخصة التجزئة بالمحافظة العقارية إلى إعلام الغير بوجود وحدات عقارية جديدة أنشئت لها بطاقات عقارية بالسجل العقاري ، فيجعل منها حجة على الكافة. الكلمات المفتاحية: رخصة التجزئة – الشهر العقاري – شهادة قابلية الاستغلال السجل العقاري – وحدات عقارية.
