المؤسسات الناشئة في مواجهة الفساد و استراتيجيات النجاح

Abstract

أصبح الفساد ظاهرة عابرة للحدود، لا تقتصر آثاره على دولة بعينها، بل يمتد ليشكل تحديًا عالميًا يستعصي على المعالجة من خلال الإجراءات الوطنية المحدودة، لا سيما في ظل الطفرات العلمية والتكنولوجية المتسارعة التي ساهمت في تطور أساليب ووسائل ارتكاب الجرائم بشكل عام، وجرائم الفساد بشكل خاص. فقد بات الفساد يأخذ أشكالًا جديدة ومعقدة يصعب أحيانًا اكتشافها وملاحقتها. ونتيجة لهذه التطورات، حظي موضوع مكافحة الفساد باهتمام واسع على الصعيدين المحلي والدولي، حيث أصبحت معظم البرامج الحكومية تتضمن استراتيجيات وخططًا تهدف إلى الحد منه، خاصة في الدول النامية التي تُعد مكافحته فيها شرطًا أساسيًا لتحقيق التنمية المستدامة. وفي هذا السياق، تطرح هذه المداخلة إشكالية رئيسية مفادها: ما مدى فعالية الاستراتيجية القانونية الوطنية المعتمدة لمكافحة الفساد في الجزائر؟ وكيف يمكن للمؤسسات الناشئة أن تسهم في تعزيز هذه الاستراتيجية وتطوير آليات مبتكرة لنجاحها في ظل التحديات الراهنة؟ الكلمات المفتاحية: الفساد، القانون الجزائري، السياسة الجنائية، الجرائم الاقتصادية، المؤسسات الناشئة، استراتيجيات النجاح. Abstract: Corruption has become a cross-border phenomenon, with effects that are no longer confined to a single country. It now poses a global challenge that cannot be effectively addressed through national measures alone, especially in light of rapid scientific and technological advancements that have led to the evolution of crime methods in general, and corruption in particular. Corruption has taken on new and complex forms that are often difficult to detect and prosecute. As a result, the issue of combating corruption has received significant attention at both the local and international levels. Most governmental programs now include strategies and plans aimed at reducing corruption, especially in developing countries, where addressing corruption is considered a fundamental prerequisite for achieving sustainable development. In this context, this paper seeks to answer the following main question: To what extent is the national legal strategy for combating corruption in Algeria effective? And how can emerging enterprises contribute to enhancing this strategy and developing innovative mechanisms for its success in light of current challenges?
