بطلان أحكام التحكيم التجاري في التشريع الجزائري

Abstract

اصبح يلجأ المتعاملون التجاريون الى التحكيم لأنه أحد الطرق البديلة لحل النزاعاتالناشئة عن معاملاتهم التجارية و الفصل فيها عن طريق محكمين وهيئة تحكيمية بعيدا عنقضاء الدولة . فقد لخصت دراستنا أنه بعد صدور حكم التحكيم يمكن أن يشوب هذا الحكم بعضالعيوب التي تؤدي الى بطلانه، وهذا ما إحتوته هذه الدراسة، تعد طرق الطعن المقررة لحكمالتحكيم والتي إنتهجها المشرع الجزائري بطريق طعن واحد، ألا وهو الطعن بالبطلان، لكنوبما أن المشرع الجزائري فرق بين التحكيم الوطني و التحكيم الدولي فقد أجاز الطعنبالإستئناف في التحكيم الوطني أما الدولي فأجاز له الطعن بالبطلان فقط. وذلك عن طريق رفع دعوى البطلان التي نظمها المشرع الجزائري في الباب الثانيالخاص بالتحكيم من الأمر 80-80من قانون الإجراءات المدنية و الإدارية . الكلمات المفتاحية: حكم التحكيم، الطعن في حكم التحكيم، دعوى البطلان، المشرع الجزائري.

Abstract: Commercial traders have begun to resort to arbitration becauseit is one the alternative methods for resolving disputes arisingfrom their commercial transactions and adjudicatingthemthrough arbitrators and an arbitration body awayfrom the states judiciary. Our studysummarizedthatafter the issuance of the arbitration award, thisrulingmay have somedefectsthat lead to its invalidation, and thisiswhatthisstudycontains The methods of appealprescribed for the arbitration award and adopted by the Algerian legislator are resumed in one method of appeal, which the appeal of invalidity. However, since the legislator made a differencebetween national and international arbitration, heallowed the appeal in national arbitration, but in international arbitration heallowed the appeal to invalidityonly and thatis by filing the invalidation suit, which the legislatorstated in the second chapter on arbitration of order 08-09 of the civil and administrative procedureslow.
