Abstract

تعتبر المحاكم التجارية المتخصصة التي أنشأها المشرع الجزائري فقزة نوعية في مجال القضائي متخصص، حيث تختص بالنظر في نوع معين من المنازعات أي حسب طبيعة المنازعة للفصل فيها بسرعة ، في ظل اتساع دائرة المعاملات التجارية نظرا لتوجه الجديد للاقتصاد الوطني الرامي إلى ترقية مناخ الأعمال والتجارة، بغية تحقيق خصائص النشاط التجاري المتمثلة في الثقة والإئتمان والسرعة، وفضلا عن ذلك قام المشرع الجزائريب تعزيز دور الوسائل البديلة المستحدثة لتسوية المنازعات المعروضة أمام المحاكم التجارية المتخصصة. الكلمات المفتاحية: المحكمة التجارية ، الصلح، الوساطة ، المنازعات التجارية، القضاء التجاري Abstract The specialized commercial courts established by the Algerian legislature represent a qualitative leap in the field of specialized justice. They are competent to consider a specific type of dispute, i.e., based on the nature of the dispute, with the aim of resolving it quickly. This is in light of the expansion of the scope of commercial transactions due to the new direction of the national economy aimed at improving the business and commercial climate, with the aim of achieving the characteristics of commercial activity represented by trust, credit, and speed. Furthermore. the Algerian legislature has strengthened the role of innovative alternative means for settling disputes brought before specialized commercial courts.
