مسؤولية المحافظ العقاري في التشريع الجزائري

Abstract

لحماية الملكية العقارية، اعتمدت الجزائر نظام الشهر العيني، استثناءا الشهر الشخصي في العقارات االغير ممسوحة، و اعتمدت في ذلك المحافظة العقارية التي يسيرها محافظ عقاري كموظف عمومي بصلاحيات خاصة وواسعة و دقيقة، تترتب عنها مسؤوليات تمس بأصحاب الحق من المسح و الشهر العقاريين، و تتبعها اثار، تتعلق بالتعويض او الالغاء، او الرجوع، و هاته الأخيرة تمس المحافظ العقاري، و من دراستنا نلحظ تدارك المشرع الجزائري العبء الملقى على المحافظ العقاري، باستحداث منصب المحافظ العقاري المساعد، كما لا يخفى دور رقمنة القطاع في تخفيف الأعباء، و تحقيق اهداف السياسة العقارية في مسح الأراضي. الكلمات المفتاحية :المحافظ العقاري. المسؤولية، اثار المسؤولية Abstract: To protect real estateownership, Algeria has adopted the system of real estate registration, with the exception of personal registration in unsurveyed real estate, and has adopted the real estateregistry, whichismanaged by a real estateregistrar as a public employeewithspecial, broad and precisepowers, whichentailresponsibilitiesthat affect the right holders of the real estatesurvey and registration, and are followed by effectsrelated to compensation, cancellation, or return, and the latter affects the real estateregistrar. Fromourstudy, we note that the Algerian legislator has addressed the burdenplaced on the real estateregistrar by creating the position of assistant real estateregistrar. The role of digitizing the sector in reducingburdens and achieving the objectives of real estatepolicy in land surveyingisalso not hidden.
