Abstract

تحضي قضية التعمير باهتمام واسع مع تطور المجتمعات وتباين أنماط واشكال البناء ، اذا يعتبر المراءة العاكسة لقياس المستوى الحضري للدول التي أضحت توليه مكانة تشريعية كبيرة . ثم ان تنظيم حركة التعمير في الأساس لابد ان يوفق بين المصلحة الخاصةللأفراد والمصلحة العامة للمجتمع ككل . والجزائر كغيرها من الدول سعت حثيثا بشكل مباشر أو غير مباشر لتنظيم مجال التعمير بما يحفظ حق الأفراد والمصلحة العامة معا من خلال النصوص القانونية التي ترمي علي وجه الخصوص الي ضمان استعمال رشيد للفضاء العمراني وتنظيم انتاج الأراضي القابلة للتعمير، والتي تناولت بصفة خاصة في نصوصه رخص وشهادات التعمير التي تعتبر أساس التخطيطالعمراني .
