Abstract

يُعد نظام الملكية المشتركة في العقارات المبنية أحد الأنظمة القانونية المهمة التي أقرّها المشرّع الجزائري لتنظيم العلاقة بين المالكين في البنايات ذات الطابع الجماعي. فهو يجمع بين الملكية الفردية للأجزاء الخاصة، مثل الشقق والمحلات، والملكية الجماعية للأجزاء المشتركة كالسلالم والمصاعد والسطح. ويهدف هذا النظام إلى ضمان الاستغلال المنظم والمنصف للعقار، من خلال آليات تسيير تشمل اتحاد الملاك والمسير، إلى جانب تنظيم قانوني دقيق يحدد الحقوق والواجبات لكل طرف. ورغم الجهود التشريعية المبذولة، لا يزال التطبيق العملي يواجه عدة تحديات تتعلق بضعف الوعي القانوني وصعوبات التسيير، مما يبرز الحاجة إلى تعزيز الإطار القانوني وتحسين ثقافة التعايش الجماعي. Abstract The system of joint ownership in constructed real estateis one of the key legalframeworksadopted by Algerian legislation to regulate the relationshipbetweenpropertyowners in collective buildings. It combines individualownership of privateunits (such as apartments and shops) withsharedownership of common parts like staircases, elevators, and rooftops. This system aims to ensurefair and organized use of the propertythrough management mechanismsinvolving the owners’ association and a designated manager, all within a well-definedlegal structure outliningeachparty’srights and obligations. Despitelegislative efforts, practicalimplementationstill faces challenges, particularly due to lowlegalawareness and management difficulties, which highlight the need to strengthen the legalframework and promote a culture of collective living.
