الصلح أمام المحاكم التجارية المتخصصة في التشريع الجزائري

Abstract

تبنى المشرع الجزائري الوسائل بديلة لحل النزاعات، والذي يعكس تطلعه لتطوير النظام القضائي ليكون أكثر ملائمة مع التطورات القانونية والقضائية على الصعيد الوطنــي والدولي، في هذا الاطار سعى المشرع إلى تحديث القضاء التجاري من خلال ادخال تعديلات مهمة علىقانون الإجراءات المدنية والإدارية بموجب القانون رقم 22- 13 هذا الأخير يتماشى مع متطلبات عصرنة النظام القضائي حيث أنشئت المحاكم التجارية المتخصصة والتي تعمل بالتوازي مع الأقسام التجارية التقليدية، مما يفتح المجال أمام قضاء متخصص يهدف إلى تسوية النزاعات تجارية بفاعلية أكبر. ومن بين أبرز التعديلات التي أدخلها هذا القانون الجديد هو الزامية إجراء الصلح بين الخصوم في النزاعات التجارية، حيث يعتبر الصلح خطوة جوهرية تهدف إلى ايجاد حلول ودية تجنب الأطراف التورط في إجراء ات قضائية طويلة ومعقدة. الكلمات مفتاحية:إجراء الصلح، النزاعات التجارية، المحاكم التجارية المتخصصة. Abstract: The Algerian legislator’s adoption of alternative dispute resolution methods reflects its ambition to develop the judicial system, making it more compatible with legal and judicial developments both nationally and internationally. In this context, the legislator sought to modernize commercial judiciary through significant amendments to the Code of Civil and Administrative Procedure under Law 22-13. This new law aligns with the requirements of modernizing the judicial system, as it established specialized commercial courts that operate alongside traditional commercial divisions, opening the door to a specialized judicial system aimed at resolving commercial disputes more efficiently. Among the most notable amendments introduced by this new law is the mandatory conciliation procedure between parties in commercial disputes. Conciliation is considered a crucial step aimed at finding amicable solutions that help avoid lengthy and complex judicial procedures.
